Membertou Pedway

Abstract

In this case, students are introduced to the community of Membertou, located within the Cape Breton Regional Municipality. In 2011, chief and council were working with partners DP Murphy, to build a hotel adjacent to the Membertou Trade and Convention Centre. The plan called for a pedway between the two facilities, one of which was located on reserve land (MTCC) and the other on fee simple land (hotel). After being advised that a federal permit would be required in order to acknowledge the hotel owner’s interest in the pedway and guarantee access to it, chief and council had to decide how to proceed.
